THE FOLLOWING DESCRIBES THE TERMS UPON WHICH DETAILED IMAGE OFFERS YOU ACCESS TO OUR SERVICES. BY USING THE DETAILEDIMAGE.COM WEB SITE YOU ARE AGREEING TO BE BOUND BY THESE TERMS.

We can amend this agreement at any time by posting the amended terms on the site. All amended terms will automatically be effective immediately after they are initially posted on the site unless otherwise specified. If we make material changes to this agreement, we will notify you here, by email, or by means of a notice on our home page. You can review the most current version of the Terms of Service at any time at http://www.detailedimage.com/Terms/.

Conditions

Use of the Products and Services is subject to compliance with these Terms and Conditions. You acknowledge and agree that Detailed Image may terminate your access to the Detailed Image site should you fail to comply with the Terms and Conditions or any other guidelines and rules published by Detailed Image. Any such termination shall be in the sole discretion of Detailed Image and may occur without prior notice, or any notice. Detailed Image also reserves the right to terminate any user's access to Detailed Image at its sole discretion for any reason or for no reason at all, if Detailed Image believes the user may be directly or indirectly harmful to other users, to Detailed Image or its subsidiaries, affiliates, or business contractors, or to other third parties, or for any conduct that violates any local, state, federal, or foreign laws or regulations.

Shipping Policies

Detailed Image makes every effort to ship all US orders within one business day of being placed. Occasionally there are delays beyond our control or backordered items that can cause delays. We will make every effort to contact you through email, phone, or on our website if we expect your order to take longer to ship.

FedEx ships Monday through Friday, excluding holidays and some select days for Express services. Detailed Image is not responsible for delays relating to FedEx's services or any damages resulting from delayed shipments.

All APO, International, and US territory orders will be shipped on Mondays and Thursdays via United States Postal Service with no exceptions. Detailed Image is not responsible for delays relating to United States Postal Service or any other carrier shipping service.

Estimated time of deliveries from FedEx and United States Postal Service are not guarantees and should only be used an estimate. Detailed Image is not responsible for any damages resulting from delayed deliveries. Detailed Image is also not responsible for any additional charges that result from international shipping such as duties, fees, taxes, etc.

Orders containing an aerosol product can only be shipped to US addresses via FedEx Ground. If any expedited shipping option is selected that requires air transportation the order will automatically be demoted to Ground Shipping and the proper dollar amount will be refunded when applicable. Detailed Image is not responsible for any damages resulting from delayed deliveries.

Orders that contain incorrect or undeliverable shipping information, as entered by the customer, which can not be delivered by any carrier, will have the customer be responsible for additional shipping charges to complete the delivery. If the customer then decides to cancel the order, there shall be no refund for any shipping charges. If there are charges for sending the item back to Detailed Image, the additional shipping charges are the responsibility of the customer.

Return Policies

Unopened and unused products are available for return or exchange 30 days from the date of purchase. The customer is responsible for any shipping charges back to Detailed Image and any ensuing shipping charges. Shipping charges from the original order will not be refunded. Returns of tools and machines will not be accepted and should instead be sent directly to the manufacturer.

Refunds will be issued in the form of a credit to your account or a refund to your credit card.

If you feel as though a product you have purchased through Detailed Image may be defective, returns should be made directly through the manufacturer. If you need help finding the contact information of a manufacturer you may contact us. All Porter Cable, Flex and Metropolitan Vacuum Cleaner, Co., Inc. sales are final. Returns on defective items must be sent back to the manufacturer. Each company has a manufacturer's warranty. Affiliate Policies

Below outlines some the terms of the Detailed Image affiliate program.

• Detailed Image will make all pending cash payouts on the 20th of each month. An automated email will be sent to you once a payment has been made.
• A minimum of a $25 balance must be in your account to be paid.
• Detailed Image reserves the right to terminate any persons enrollment in the affiliate program at any time without warning.
• Detailed Image requires all affiliate members to act professional towards other forum members and to respect forum rules.
• Detailed Image reserves the right to change the terms or affiliate payout structure at anytime without notice.
• Affiliate credit is awarded at the point of sale, regardless of whether or not the product is returned.

Eligibility

To use Detailed Image's services, you must be at least 18 years of age and be able to form or enter into a legally binding contract in accordance with applicable laws. If you are under the age of 18, you can use this service only in conjunction with and under the direct supervision of a parent or guardian who agrees to be bound by these terms. If you are eligible to use our services, you must complete the registration process by providing Detailed Image with true and correct information as required on the Detailed Image registration form. If the information you provide is found to be false, we may suspend or terminate your registration and account.

Stability

Neither you nor any parties affiliated with, contracted by, or created by you may take any actions to interfere with or interrupt, the operation or stability of the Detailed Image web site. This includes, but is not limited to, the use of any software, device, or programming routine that could place excessive loads on our system or interfere with any listing on our site, or any users account or information.

Account, Password, and Security

You will receive a password and account upon completing the registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You may not disclose, share, or distribute your password to any third party. If you feel your password has been jeopardized, you may change your password at any time, and as frequently as you wish by accessing the My Account section of the site. You agree to immediately notify Detailed Image of any unauthorized use of your password or account or any other breach of security, and ensure that you exit from your account at the end of each session. You also understand that the data (including your content) may be transferred unencrypted and involve transmissions over various networks. Detailed Image can not and will not be liable for any loss or damage from your failure to comply with these security obligations.

In the event that your information creates a liability to us that may cause our Internet Service Provider (ISP), suppliers, agents, or contractors to sever their services to us because of such liability, we may take appropriate actions regarding such information.

The use of your information is explained in our Privacy Policy that can be located at http://www.detailedimage.com/Privacy/ and is incorporated in this agreement by reference.

Copyright and Content Ownership

All content under the domain Detailed Image.com is protected by the copyright laws of the United States of America. You agree not to reproduce, sell, or exploit any portion of Detailed Image without the express written consent of Detailed Image.

You retain all intellectual property rights over information and material that you provide in conjunction with the use of the Detailed Image service. Detailed Image has the right in their sole discretion to review and remove any content for any reason.

Limitation of Liability - Non Warranty

IN NO EVENT SHALL Detailed Image (INCLUDING OUR SUPPLIERS, OFFICERS, DIRECTORS, EMPLOYEES) BE LIABLE FOR LOST PROFITS, REVENUES, OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) RESULTING FROM OR IN CONNECTION WITH THIS AGREEMENT OR THE USE OF THE SITE.

THE SITE AND SERVICES ARE OFFERED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTIES OR GUARANTEES EXPRESSED OR IMPLIED. WE AND OUR SUPPLIERS SPECIFICALLY DISCLAIM THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON INFRINGEMENT.

Breach

Without limiting other remedies, we may limit your activity, immediately remove your account, warn our community of your actions, issue a warning, temporarily suspend, indefinitely suspend or terminate your membership and refuse to provide our services to you if: (a) you breach this agreement or the documents it incorporates by reference; (b) we are unable to verify or authenticate any information you provide to us; or (c) we believe that your actions may cause financial loss or legal liability for you, our users or Detailed Image.

Erroneous Chargebacks

Detailed Image will pursue, to the fullest extent of the law, the recovery of all funds resulting from erroneous credit card chargebacks.

Indemnification

You agree to indemnify and hold harmless Detailed Image, its officers, employees, parent companies, subsidiaries, contractors, vendors or affiliates, from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of Detailed Image, the violation of this User Agreement by you, or the infringement by you or any other user of this site using your computer, of any intellectual property or other right of any person or entity.

Legal Responsibility

It is your responsibility to comply with all applicable laws, statutes, ordinances and regulations regarding your use of our service and your listing, purchase and sale of items through our site.

Violation of User Agreement

We may terminate your account, registration temporarily or permanently should you violate any portion of this User Agreement. Detailed Image reserves the right to refuse service to anyone for any reason at any time. The failure of Detailed Image to enforce any provision of this document does not constitute a waiver of such provision.
